Internal whistleblower office

Indication

The Whistleblower Protection Act (HinSchG) came into force on July 2, 2023. The aim of the HinSchG is to protect persons who have obtained information about legal violations in the course of their professional activities and report them. The law prohibits any discrimination against whistleblowers and therefore obliges employers with at least 50 employees to set up secure channels for reporting violations (internal reporting offices).

To this end, we have set up an internal reporting office that you can contact confidentially.

 

Who can report violations?

The reporting office is open to all employees and other persons who have become aware of violations in connection with their professional activities at our company. Former employees and applicants can also contact the reporting office.

 

Which violations can be reported?

The scope of application of the HinSchG includes violations of the law as defined in Section 2 HinSchG. These include, among others:

  • Criminal offenses, e.g. corruption, theft, fraud,
  • Violations subject to fines if the violated regulation serves to protect life, limb or health or to protect the rights of employees or their representative bodies (e.g. regulations in the areas of occupational health and safety, violations of the Minimum Wage Act, etc.)
  • Violations of environmental law, radiation protection and nuclear safety regulations
  • Violations of regulations on the protection of personal data and the confidentiality of (electronic) communication and information technology security
  • Violations of regulations in procurement procedures
  • Statements made by civil servants that constitute a breach of the duty of loyalty to the constitution.

Information about private misconduct is not covered by the HinSchG.

We have entrusted Mr. André Kamitz, who can be contacted at Hinweisgeberstelle(at)stafag.com, with the tasks of the internal reporting office in accordance with Section 14 (1) HinSchG. Alternatively, the internal reporting office can also be contacted Monday to Friday between 8:00-16:00 on 0208 5801 461. This excludes national holidays and public holidays in North Rhine-Westphalia.

The Reporting Office maintains the confidentiality of the identity of the person making the report, the persons who are the subject of a report and the other persons named in the report. In principle, the identity is only known to the persons responsible for receiving the reports or taking follow-up action, as well as to the personnel assisting in the fulfillment of these tasks (§§ 8, 9 HinSchG).
